You can’t do anything until the divorce is final, then that becomes fraud, but until then you are still liable for all the bills and debts that she runs up on credit cards.
If your still married there isn’t much you CAN do unless you had it state in the original papers that all debts she incurred as of the date the papers were filed you would not be responsible for.
if you have an attorney turn this over to him or if not, petition the courts for a cease and desist order on using your credit or face breach of court order. You can also contact the credit reporting companies and put adisclaimer explaining the situation in you packet so anyone contemplating issuing credit will see it first and put into it that you will not be responsible for any future debts incurre by her after this date
Contact your lawyer. If you don’t have one you need one right now. Also contact the companies that have given her credit. Tell them to shut down the line. Explain you are not the responsible party for payment. Make sure you get a letter assuring you that you are off the account.
It varies state to state. As a minimum you will have to file papers for a divorce in the County in which you reside. Once the proper documents are filed call your credit card companies immediately and cancel all your cards. Also, for a small fee you could put a notice in the legal section of the classified ads in the newspaper to read,
Go to your nearest credit bureau with divorce decree in hand and ask them to separate your accounts. They’ll take it from there.
